Legal Separation

Under Illinois law, legal separation is a means for spouses to live separately and apart without obtaining a divorce.

A legal separation provides couples with a formal legal structure to set up rules regarding property, support and custody. However, because legally separated couples remain married to each other, they cannot remarry, absent their obtaining a subsequent divorce.

Our attorneys are knowledgeable with respect to assisting clients in understanding the differences and legal ramifications of a legal separation as opposed to a divorce as well as in drafting a requisite legal separation agreement.
